Telford Homes ignores Tower Hamlets Planning - again!

Below is the letter which the MERA Chair sent last week to Owen Whalley, Head of Planning and Development Control for Tower Hamlets Council.

It relates to Open Space 2 next to Coniston House and the failure of EastendHomes and Telford Homes to submit a planning application for the creation of a temporary car park during the construction period.

First they constructed a car park without proper (required) permission from Tower Hamlets Planning.  Now they've failed to apply for that permission within the required time limit, despite being told to do so by Planning Enforcement!

Is this yet another example of Telford Homes ignoring what Tower Hamlets Planning has to say?  We're developing a VERY long list of instances where this has happened to date across EastendHomes estate redevelopments in Tower Hamlets.

The cumulative effect is to undermine our confidence in the whole planning process in Tower Hamlets.

PETITION FROM 45 RESIDENTS OF CONISTON HOUSE

Please see attached petition from the residents of Coniston House.
(hard copy to be delivered by hand - with possible additional signatures when block reps report back this evening)

We, residents of Coniston House would like to thank you and your department for your interest in our concerns about the development of our car park to the rear of our block.
We ask that when the planning application for a temporary car park is passed that conditions are included to ensure the area is completed in accord with the approved plans within a reasonable time.

There are 66 properties in the block.  The petition includes 45 signatures from 44 properties.  Those who have not signed were out when the local block representative visited their home.  Nobody refused to sign.

As I understand the situation at present is the developers were given a deadline of 28 days to submit a planing application to use the site as a temporary car park on the 16th August. The deadline has now passed. After a conversation with Thomas Doyle (Planning Enforcement Officer) last week it seems no application has been submitted and he is in the process of following this up.

Coniston House - an UPDATE

These are the recent blog posts on MILE END RESIDENTS' NEWS about the changes to the open space in the area surrounded by Coniston House - and an update about the outcome.

These are the previous posts about the sudden enclosure and tarmacing of open space and removal of too little soil without proper precautions being observed in relation to the soil contamination:
In response to the petition by Coniston House residents and the representations MERA made to the Council's Planning Enforcement Officers MERA received a letter from Owen Whalley Head of Planning and Building Control.  

In summary:
  • Eastend Homes says the tarmac area is temporary and will be remediated and reinstated when construction works are complete
  • Eastend Homes MUST submit an application for temporary planning permission in order for the Council to obtain local residents views and determine if the car parking arrangements are acceptable and
  • issues re dust from the contaminated soil have been referred to Environmental Health

Investigation of loss of green open space at Coniston House.

Last week we reported that A Petition from Coniston House residents had been presented to the Council.  This related to Telfords Homes plc tarmaccing the green open space between the three blocks which comprise Coniston House.
CLEARLY THE AMENITY AND THE HEALTH AND SAFETY OF LOCAL RESIDENTS HAVE BEEN AFFECTED BY THIS DEVELOPMENT 
The Planning Enforcement Officer visited the site and agrees that the majority of open space has now been tarmacced.

No grass - only tarmac!

He was told the following:
  • it's proposed as a temporary arrangement for resident parking
  • the open space will be re-instated in accordance with the planning permission granted when this phase of the development is implemented.
In his letter to MERA, he's indicated that he's asked for further clarification of this matter - and MERA would like to know more too.

What MERA Thinks
  • Coniston residents now suffer a LOSS OF AMENITY AND SIGNICANT GREEN SPACE for an indefinite period.
  • Coniston House residents were NOT CONSULTED about this specific development
  • Coniston House residents received NO COMMUNICATION in advance of the development
  • The rationale for this development - temporary or otherwise - is NOT EXPLAINED in any of the documents submitted to LBTH Planning to date
  • Consequently there is no reference to this development in the Decision Notice - ie it is NOT PERMITTED
What MERA Wants to Know
  • Which residents parking spaces does this relate to? 
  • Why do these need to be relocated and reprovided on green open space?
  • Why do they need to be reprovided at all given that there has always been a plan to reduce the number of available parking spaces on the Estate?
  • Why does the Schedule of Works - not as yet provided to LBTH Planning - not address this issue without the need to remove green open space?
  • How long is this green space required to act as a car park
  • Where is the open space amenity to replace the amenity lost by Coniston Residents? 
Importantly:
  • Why is Open Space 2 not referenced in the Enforcement Letter under Breach of Condition 3 (Contamination)?  Soil was excavated without any of the safeguards in place.  
  • Why is Open Space 2 not referenced under the Breach of Condition 5?  Trucks were photographed behaving in an unsafe way on EastendHomes land (ie NOT a public highways matter).

Multiple Power Cuts in Mile End still unexplained

Buildings in and around the Eric and Treby Street Estate have been suffering a number of power cuts for the last four weeks. 

We think there have been four in total.  They've started since Telford Homes plc have been on site and plugging in to the Estate electricity supply - although this may be coincidental. The last one was on the night of 14th-15th July.

This is the sequence of events for the latest power cut - as recorded by Mark Taylor, the Chair of MERA, and other residents on the 17th floor of  Ennerdale House.

Emergency Lights on landing and stairs: lights dimmer than usual but OK.
22.30MERA Secretary reports to EDF Emergency Line
EDF say they could see a fault on the system - probably a fuse in a sub station on Southern Grove.
Engineers called but could not give ETA of power supply.
15th July01.41EDF log: Job was reclassified from "fuse" to "underground network fault".  Engineers attempted work around (?) at LB6 (Link Box 6)
02.00ish17th floor:  power came back on temporarily
03.09 EDF log:  Engineer reports verbal abuse from member of the public while attempting to use "sniffer"
04.31EDF log:  Power returned
05.30Chair of MERA called EDF emergency line to find out reason for power cut.  They could not say but suggested he call back later.
05.40Chair of MERA called LBTH emergency service and reported lift serving odd floors still not working and lack of water to pump not working.  (The pump needs to be restarted after every power cut and any air block cleared before water pumps to top floors.)

Told this would be fixed by midday (ie 14 HOURS AFTER WATER LOST).

06.50Water back on to top floors of Ennerdale House. 
08.303 EDF engineers on Hamlets Way probing the pavement with device and taking notes on clip board.  They said they were still investigating fault and may have to cut power again - but not to Ennerdale.
09:00Power to Ennerdale House went off again!

EastendHomes posted this letter (see below) to residents of Coniston House, Ennerdale House, Beckley House, Windermere House and Derwent House

However it needs to be noted that the fault also affected the private houses in Eric Street as well.


Two important points:
  • EastendHomes and/or its agent LBTH Emergency Service are responsible for supplying drinking water to ALL HOMES which are without drinking water supplies as a result of the pump not working.  
Thames Water are obligated to arrange for an alternative supply, such as by water tanker or standpipe, they cannot put your supply back on within 6 hours of the interruption.  The same standard should apply to EastendHomes if a pump is not fixed and water supply restored to all tenants and leaseholders within 6 hours.
  • Since the fault (and associated power cuts) has only started happening since Telford Homes has been on site, EDF Energy, EastendHomes and Telford Homes plc need to make sure - as a matter of priority - that the fault is not caused by anything that Telford Homes have done when digging holes and plugging into the network supply.

Tip:  Until such time as there is an adequate explanation of what the fault is and confidence that it has been fixed we suggest that you keep a stock of drinking water at home which is adequate for 6 hours - especially if the weather is hot and you have small children.

A Petition from Coniston House residents

Members of Mile End Residents Association who live in Coniston House - on Eastendhomes' Eric and Treby Street Estate - are today sending a petition to:
  • Owen Whalley, Head of Planning and Development Control at Tower Hamlets Council and 
  • Ted Wojewodka, Manager - Complaints Team (London) Health and Safety Executive.
[Update 12th July 2010: We've received a very prompt written response from Owen Whalley, promising to look into this matter]
     The petition results from:
    • the recent excavation of the grass and soil and tarmaccing of "Open Space 2" (the space in the middle of the Coniston House blocks), part of the Eric & Treby Street development - with no prior notice and no notified indication of why it is there
    • the lack of any indication in the draft Construction Management Plan of any works in this area other than those relating to the redevelopment of the Open Space for recreational purposes.
    • the general lack of any attention to health and safety issues on this site by the contractor Telford Homes plc
    • the breach of planning permission and planning conditions
    • the generally very poor level of communication with residents
    • the total lack of notification to residents of Coniston House of any works in their area and the timing of works (eg the development of the undercroft; the development of the open space). 


    The petition states the following:
    The car park at Coniston House has been extended during the first week of July.  This was not part of the building plans that were approved by the Council, which showed the area as part car park and part play ground.  The car park now encroaches on the space that was planned to be used as a playground.  Residents were not informed or consulted about the change.

    Residents are also concerned that site traffic is going the wrong way around the site and construction trucks are manoeuvering without banksmen to ensure the safety of pedestrians and other road users

    We demand that the works are changed back to the original plans and that residents are consulted about any future work in this area.
    83% of the properties signed and 100% of those who were asked.  There are 66 properties in the block.  The petition includes 56 signatures from 55 properties .  Those who have not signed were out when the local block representative visited their home.  Nobody refused to sign.
      
    What do local residents think?  

    Residents made the following points when signing the petition

    • Residents generally commented about the total lack of any notification about what was happening and the overall level of noise
    • Nobody notified a lady who is asthmatic.  She was very upset by the development as the dust really affected her asthma and she wasn't given any warning.
    • Many residents do not know about the new 1 bed flats to go in the undercroft area of Coniston House
    • Many families had been looking forward to having a Play Area next to Coniston House as Mile End Park is too far away across a busy road.  They are upset that the grass has been taken.  The grass is used including for dog walking.
    • The railings block access from the car park to the main block doors. One one you have to fight through a tree in order to get through
    • In the absence of any communication from EastendHomes or Telford Homes, people think the tarmac will be used for car parking spaces.  They commented that there are plenty of empty car parking spaces.  Residents do not feel that there is any need for any more.

    Contaminated soil extracted: Residents were also not aware that the site which was excavated was contaminated ground and that the soil excavated required controls attached to its excavation which were not evident to any of those who watched the excavation.

    Site traffic breaching planning conditions:  We have already commented to both the Council and the Health and Safety Executive (responsible for construction sites) about the complete disregard for local residents demonstrated by drivers of the HGV vehicles taking away the soil (see MERA Blog Eric & Treby Site Traffic "out of control").  We also saw no evidence of any the health and safety measures identified in the plans submitted to date - even though these are not, as yet, approved.

    CLEARLY THE AMENITY AND THE HEALTH AND SAFETY OF LOCAL RESIDENTS HAVE BEEN AFFECTED BY THIS DEVELOPMENT

    It is INTOLERABLE (and maybe illegal?) for buildings works to be taking place:
    • in the absence of a construction management plan approved by Tower Hamlets Council - See MERA blog posts Construction Management Plan - REFUSED and WHY the Eric & Treby Construction Management Plan was refused
    • in the absence of an approved site contamination/remediation plan - for a Development Site which has been identified by experts as being contaminated with Arsenic, Nickel, Lead and poly-aromatic hydrocarbons - see MERA Blog Post Eric & Treby Estate: Site Contamination
    • in the absence of any measures to reduce dust and its impact on people living nearby with respiratory problems such as asthma
    • in the absence of satisfactory measures to comply with the details of all other pre-commencement planning conditions
    So far as we are aware Tower Hamlets Council has a statutory duty of care towards the residents of this borough which involves exercising such powers as it has under planning and health and safety legislation to ensure that residents are NOT exposed to undue and avoidable risks.  That, as we understand, forms the basis for many of the terms of the planning permission and planning conditions which are currently being ignored.

    WHAT MERA WANTS TO SEE HAPPEN

    We want the statutory agencies to make sure that:
    • all work on this site is STOPPED until such time as ALL appropriate pre-commencement planning conditions have been satisfied. 
    • the construction management plan (when finally approved) includes detailed/stipulated arrangements for communicating explicitly and promptly with ALL tenants - at all stages of this development - as and when required (ie BEFORE works start)
    • all health and safety aspects of this development are comprehensively addressed - by Telford Homes plc and Eastend Homes in liason with Tower Hamlets Council and the HSE London Team responsible for construction sites
    • the construction management plan and all other plans which relate to the creation of dust MUST create an environment which does not jeopardise the health of people living nearby who have serious respiratory problems.  This is particularly important given the fact the site is contaminated and includes carcinogenic material. It is not acceptable to excavate soil without precautions and/or create a development which could lead to people having their health put at risk, leading them to being admitted to hospital or worse.  The site must be SAFE for those with respiratory/disability problems.
    • Everybody responsible for the development of this site MUST have a complete and accurate appreciation of the dangers of dust for those with respiratory problems and act accordingly.  Otherwise they render themselves liable to prosecution.  Ignorance is not a defence in law for developments such as this.

    Veolia not emptying recycling bins

    EITHER Mile End residents within the MERA area are getting much better at recycling

    OR Veolia is getting much worse at collecting refuse from the purple recycling bins

    This was the scene in Tony Cannell Mews at the end of Coniston House last Friday afternoon (25th June).

    This was the scene that we spotted yesterday - Thursday 1st July - in Treby Street.



    We'll be sending both Veolia and Tower Hamlets Council waste management officers a link to this blog post and asking for an explanation as to why they think we should put up with sights like this.
    • So Veolia - what's the explanation?  Was this a missed round - in which case why was there no catch-up given that these bins would sit around over the weekend?  Maybe the frequency of collection needs to be reviewed?
    • Do Tower Hamlets Officers monitoring the Veolia contract need to get better in spotting breaches of waste collection standards?

    Note to MERA members:  If you see an overflowing refuse bin you can get it sorted PDQ by reporting it using Fixmystreet.  Our experience is that this works faster than ringing the Council's hotline.
